We are committed to delivering quality equipment, expert services, and transparent customer agreements.
These Terms & Conditions outline the legal guidelines and responsibilities that apply when you rent equipment, purchase products, or engage us for services. Please review the sections below carefully, and download the full detailed agreements for your records.
1. General Provisions
The following provisions apply to all transactions with Titan:
- Quotations & Validity – Quotes are valid for a limited period (typically 30 days) and subject to change without notice until accepted in writing.
- Payment Terms – Standard payment terms are Net 30 days from the invoice date unless otherwise stated in your contract. Late payments may incur finance charges.
- Taxes – Prices exclude applicable sales, use, VAT, or similar taxes unless otherwise stated. You are responsible for paying all applicable taxes.
- Insurance – Certain rentals and services require proof of specified insurance coverage before equipment delivery or service commencement.
- Limitation of Liability – To the fullest extent allowed by law, Titan’s liability is limited to the amounts paid for the applicable transaction, and we are not liable for indirect, incidental, or consequential damages.
- Force Majeure – We are not liable for delays or non-performance due to events beyond our reasonable control, including natural disasters, supply chain disruptions, or labor disputes.
- Governing Law – These Terms are governed by the laws of the jurisdiction where our Clayton, NC office receives the order.
2. Equipment Rentals
When renting from Titan, you agree to the full Terms & Conditions of Rentals. Key points include:
- Rental Periods & Charges – Rentals are billed based on agreed-upon daily, weekly, or monthly rates. Standby and overtime use are charged according to contract terms.
- Customer Responsibilities – Proper operation, daily maintenance, and safeguarding of rented equipment are required.
- Off Rent Process – You must contact Titan to obtain an official “Off Rent Call Confirmation Number” to end billing.
- Loss & Damage – Any damage beyond normal wear or loss of equipment will be billed at full replacement value.
3. Product Sales
Purchases from Titan are governed by the Terms & Conditions of Sale. Key points include:
- Title & Risk of Loss – Title passes when risk of loss transfers, usually at our facility unless otherwise agreed.
- Warranties – New goods are covered by limited warranties per product documentation; used goods are sold “AS IS.”
- Returns – Require prior authorization and may be subject to a restocking fee.
- Payment – Standard payment is due within 30 days; export shipments may require advance payment or a letter of credit.
4. Services
Service agreements are covered by our Terms & Conditions for Services. Key points include:
- Scope of Work – Services will be performed to industry standards using qualified personnel.
- Customer Obligations – You must provide access, permits, and necessary information for safe and efficient service.
- Change Orders – Any change in scope, schedule, or site conditions may require a written Change Order and adjusted pricing.
- Liability – Our liability for service work is limited to the remedies outlined in the service agreement.
